TERMS OF SERVICE
Last Updated: August 12, 2026
OVERVIEW
This website is operated by EasyChange Inc., doing business under the trade name Fountjoy Water Features (“Fountjoy,” “we,” “us,” or “our”).
Fountjoy Water Features operates this website and offers information, products, online shopping, showroom information, customer support, and related services through the website (collectively, the “Services”).
By visiting our website, using any part of the Services, or purchasing products from us, you agree to be bound by these Terms of Service (“Terms”), together with any additional policies referenced on our website, including our Refund Policy, Shipping Policy, and Privacy Policy.
Please read these Terms carefully before using our website or placing an order. If you do not agree with these Terms, you should not access or use the Services.
Nothing in these Terms limits, excludes, or waives any consumer right, warranty, condition, or remedy that cannot legally be limited, excluded, or waived under applicable law.
Our online store is hosted through Shopify, which provides the e-commerce platform used to offer our products and Services online.
SECTION 1 — ONLINE STORE TERMS
By using the Services, you represent that you are at least the age of majority in your province, state, or jurisdiction of residence, or that you have obtained any consent required by applicable law.
You may not use our website, products, or Services for any unlawful or unauthorized purpose.
You must not:
-
violate applicable laws or regulations;
-
infringe intellectual property or other legal rights;
-
transmit viruses, malware, malicious code, or other harmful material;
-
interfere with the operation or security of the website;
-
attempt to gain unauthorized access to the website or related systems; or
-
use the Services for fraudulent or deceptive activity.
A material violation of these Terms may result in suspension or termination of access to the Services.
SECTION 2 — GENERAL CONDITIONS
We reserve the right to refuse or limit Service where reasonably necessary, including for suspected fraud, abuse, unauthorized resale, security concerns, inventory limitations, payment issues, or violations of these Terms.
Information transmitted through the Services may pass through third-party networks and service providers.
Payment information is handled through the payment systems available through our e-commerce platform and payment providers.
You may not reproduce, duplicate, copy, sell, resell, commercially exploit, or misuse any part of the Services without our prior written permission, except as permitted by applicable law.
Section headings are provided for convenience only and do not affect the interpretation of these Terms.
SECTION 3 — PRODUCT INFORMATION
We make reasonable efforts to provide accurate product information, including photographs, descriptions, dimensions, finishes, specifications, features, and prices.
However, you acknowledge that:
-
colours and finishes may appear differently depending on screen settings, photography, lighting, and environment;
-
measurements may be approximate unless expressly stated otherwise;
-
decorative textures and finishes may vary slightly between individual products;
-
the appearance of flowing water, lighting, reflections, and other visual effects may differ depending on installation and surroundings; and
-
specifications may be updated where reasonably necessary.
Product images are intended to represent the product as accurately as reasonably possible but may include staging, props, landscaping, or surrounding décor that is not included with the product unless specifically stated.
Please review the individual product listing before purchasing.
SECTION 4 — PRODUCT AVAILABILITY AND SHOWROOM DISPLAY
Product inventory and showroom display availability may change without notice.
Some products displayed on our website may also be available to view at our Scarborough showroom. However, not every product listed online is necessarily available for physical display or immediate pickup.
If you are planning to visit the showroom to see a specific product or model, we recommend contacting us before travelling to confirm current display or inventory availability.
We may discontinue products, introduce new products, or change available models at any time.
SECTION 5 — PRICES AND PROMOTIONS
Product prices are displayed in the currency shown on the website.
Applicable taxes, delivery charges, special handling costs, or other applicable charges will be disclosed where required before completion of the transaction.
Prices and promotions may change without notice before an order is placed.
Promotional offers may:
-
have specific start and end dates;
-
apply only to selected products;
-
require a promotional code;
-
be subject to inventory availability; or
-
contain additional stated conditions.
Unless otherwise stated, promotions cannot be combined.
We reserve the right to correct genuine pricing, promotional, technical, or typographical errors.
If a material pricing error affects an order after it has been submitted, we may contact you to explain the issue and, where permitted by applicable law, provide available options, including cancellation and refund.
SECTION 6 — ORDERS
Submitting an order does not guarantee acceptance or product availability.
We may refuse, limit, hold, or cancel an order where reasonably necessary, including because of:
-
insufficient inventory;
-
incorrect product or pricing information;
-
payment authorization issues;
-
suspected fraudulent activity;
-
delivery restrictions;
-
inaccurate customer information;
-
technical errors; or
-
orders that appear to be placed for unauthorized resale.
If we cancel an order after payment has been collected, the applicable amount will be refunded using an appropriate payment method.
You agree to provide accurate and complete:
-
name;
-
billing information;
-
shipping or delivery address;
-
email address;
-
telephone number; and
-
other information reasonably required to process your order.
You are responsible for promptly notifying us if order information needs to be corrected.
SECTION 7 — PAYMENT
Payment must be made using one of the payment methods offered at checkout.
Orders may be subject to payment authorization and fraud screening.
We do not guarantee that every payment method will be available for every transaction.
Where a payment is declined, reversed, disputed, or otherwise not successfully completed, we may delay or cancel fulfillment to the extent permitted by law.
SECTION 8 — SHIPPING AND DELIVERY
Shipping and delivery availability depend on factors including:
-
product size and weight;
-
delivery location;
-
carrier availability;
-
inventory;
-
accessibility of the destination; and
-
whether special handling is required.
Available shipping or delivery options and applicable charges may be shown at checkout or communicated separately where additional arrangements are required.
Large or oversized water features may require local delivery, showroom pickup, freight service, or other special fulfillment arrangements.
Delivery dates and transit times are estimates unless expressly guaranteed.
Delays may occur because of:
-
carrier delays;
-
severe weather;
-
inventory issues;
-
access restrictions;
-
transportation interruptions; or
-
circumstances outside our reasonable control.
Nothing in this section limits rights available to consumers under applicable law in relation to delayed or undelivered goods.
SECTION 9 — SHOWROOM PICKUP
Selected products may be eligible for pickup from our showroom.
Our showroom is located at:
Fountjoy Water Features
1399 Kennedy Rd, Unit 12
Scarborough, ON M1P 2L6
Canada
Where pickup is available, please wait until we confirm that your order is ready before travelling to the showroom.
Customers may be required to provide order information or identification when collecting an order.
Customers are responsible for ensuring that their vehicle and transportation arrangements are appropriate for the size and weight of the purchased product.
Our team may provide reasonable assistance where available, but customers remain responsible for safely securing and transporting products after pickup.
SECTION 10 — RETURNS, REFUNDS AND EXCHANGES
Returns, refunds, exchanges, cancellations, damaged products, and incorrect products are governed by our Refund Policy, together with any rights available under applicable law.
Please inspect your product promptly after delivery or pickup.
If your product is:
-
damaged;
-
defective;
-
incomplete; or
-
materially different from the product ordered,
please contact us as soon as reasonably possible.
We may request photographs, video, packaging information, order details, or other reasonable evidence to help assess the issue.
Products should not be returned without following the return instructions provided by Fountjoy.
Nothing in our Refund Policy or these Terms limits any statutory rights or remedies that cannot legally be limited.
SECTION 11 — WATER FEATURE INSTALLATION AND USE
Water features must be installed, operated, maintained, stored, and winterized according to the instructions and warnings provided with the product.
Before installing a water feature, customers should consider whether the intended location is suitable, including:
-
available space;
-
surface strength and stability;
-
level placement;
-
electrical access;
-
indoor or outdoor suitability;
-
drainage;
-
water management;
-
freezing temperatures;
-
weather exposure; and
-
required clearances.
Where electrical, plumbing, structural, landscaping, or other specialized work is required, customers should use appropriately qualified professionals where necessary.
Customers are responsible for complying with applicable building requirements, condominium rules, landlord requirements, electrical requirements, and local regulations.
Product-specific installation and safety instructions take priority over general information on our website.
SECTION 12 — OUTDOOR USE AND WEATHER CONDITIONS
Products described as suitable for outdoor use must still be operated and maintained appropriately for local weather conditions.
Freezing temperatures may damage water remaining inside pumps, tubing, basins, reservoirs, or other components.
Customers are responsible for following appropriate seasonal maintenance and winterization procedures.
Water resistance or outdoor suitability does not mean that every component can be continuously submerged, exposed to extreme weather, or used contrary to its product instructions.
SECTION 13 — ACCURACY OF WEBSITE INFORMATION
We make reasonable efforts to keep website information accurate and current.
Occasionally, information may contain:
-
typographical errors;
-
incorrect specifications;
-
pricing errors;
-
outdated inventory information;
-
incorrect promotional information; or
-
other omissions.
We reserve the right to correct or update such information when discovered.
Where an error materially affects an order already placed, we will address the matter in accordance with applicable law.
SECTION 14 — OPTIONAL AND THIRD-PARTY SERVICES
Our website may use third-party services, including:
-
Shopify;
-
payment processors;
-
shipping and delivery providers;
-
Google Maps or mapping services;

-

Third-party services may be governed by their own terms, conditions, and privacy policies.
We are not responsible for the operation, availability, content, or practices of third-party services that we do not control, except to the extent responsibility cannot legally be excluded.
Use of third-party services is subject to the terms applicable to those services.
SECTION 15 — THIRD-PARTY LINKS
Our website may contain links to third-party websites.
A link does not necessarily mean that Fountjoy endorses or controls the third-party website.
We are not responsible for third-party:
-
website content;
-
privacy practices;
-
product information;
-
security;
-
services; or
-
transactions.
Please review the terms and policies of third-party websites before using them or completing a transaction.
SECTION 16 — REVIEWS, COMMENTS AND USER CONTENT
You may voluntarily provide reviews, photographs, comments, suggestions, feedback, or other content.
You represent that you have the right to submit such material.
You must not submit content that:

-
is unlawful, threatening, defamatory, abusive, obscene, or deceptive;
-
falsely represents your identity;
-

-
otherwise violates applicable law.
Where you voluntarily provide content for publication, review, promotional use, or similar business purposes, you grant EasyChange Inc. a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt, and publish that content in connection with Fountjoy's business, subject to applicable law.
We may remove user content where reasonably necessary.
SECTION 17 — PERSONAL INFORMATION
Personal information submitted through our website is handled in accordance with our Privacy Policy and applicable privacy laws.
Our Privacy Policy explains how personal information may be collected, used, disclosed, stored, and protected.
Please review our Privacy Policy before submitting personal information.
SECTION 18 — INTELLECTUAL PROPERTY
Unless otherwise stated, website content and materials, including:

You may access and use the website for personal shopping and informational purposes.
You may not reproduce, publish, distribute, modify, sell, commercially exploit, or systematically extract website content without prior written permission, except where permitted by law.
SECTION 19 — PROHIBITED USES
You may not use the website or Services:
-
for unlawful purposes;
-
to solicit unlawful activity;
-
to violate applicable laws or regulations;
-
to infringe intellectual property rights;

We may restrict access to the Services for violations of this section.
SECTION 20 — DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, the website and Services are provided on an “as available” basis.
We do not guarantee that the website will always be:
-
uninterrupted;
-
completely error-free;
-
continuously available; or
-
free from all technical issues.
Product warranties, if any, are limited to warranties expressly stated:
-
on the applicable product page;
-
in documentation supplied with the product; or
-
separately in writing by Fountjoy.
Nothing in these Terms excludes any warranty, condition, statutory right, or remedy that cannot legally be excluded.
SECTION 21 — LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, EasyChange Inc., doing business as Fountjoy Water Features, together with its directors, officers, employees, affiliates, contractors, service providers, and suppliers, will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website, Services, or products where such liability may lawfully be excluded.
This may include, where legally permitted:
-
loss of profits;
-
loss of revenue;
-
loss of data;
-
loss of opportunity; or
-
similar indirect losses.
Nothing in these Terms excludes or limits liability where exclusion or limitation would be prohibited by applicable law.
Nothing in these Terms limits statutory consumer rights or remedies.
SECTION 22 — INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless EasyChange Inc., Fountjoy Water Features, and our affiliates, directors, officers, employees, contractors, and service providers from third-party claims arising directly from:
-
your unlawful use of the Services;
-
your material breach of these Terms; or
-
your violation of another person's legal rights.
This section does not apply to the extent that a claim results from our own act, omission, negligence, or other legal responsibility.
SECTION 23 — FORCE MAJEURE
To the extent permitted by law, we will not be responsible for delays or failure to perform caused by events outside our reasonable control.
Examples may include:
-
severe weather;

Where such an event affects an order, we will make reasonable efforts to communicate with affected customers and determine appropriate next steps.
Nothing in this section limits statutory rights that cannot legally be limited.
SECTION 24 — SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed where necessary.
The remaining provisions will continue in full force and effect.
SECTION 25 — TERMINATION
These Terms remain effective while you use the Services.
You may stop using the Services at any time.
We may suspend or terminate access where reasonably necessary because of:
-
a material violation of these Terms;
-
fraudulent activity;
-
security concerns; or
-
unlawful use of the Services.
Provisions that are intended by their nature to survive termination will continue to apply.
SECTION 26 — ENTIRE AGREEMENT
These Terms, together with the policies and other terms referenced on our website, constitute the agreement governing your use of the Services.
If a separate written agreement expressly applies to a particular product, transaction, service, or arrangement, that agreement will govern to the extent of any inconsistency.
Our failure to enforce a provision immediately does not waive our right to enforce it later.
SECTION 27 — GOVERNING LAW
These Terms and your use of the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, subject to any mandatory consumer protection laws or other rights that apply to you.
Nothing in this section deprives a consumer of protections that cannot lawfully be waived or restricted.

We may update these Terms from time to time to reflect changes to:
-
our business;
-
products or Services;
-
website functionality;

policies; or
-
applicable legal requirements.
The latest version will be published on this page with an updated “Last Updated” date.
